Data protection information for applicants

We are delighted that you have shown an interest in us and are applying or have applied for a position with our client. In the following we want to inform you about the processing of your personal data regarding your application.

Who is responsible for data processing?
sibecon GmbH is responsible within the meaning of data protection law.

Nelkenstraße 7
66119 Saarbrücken
info@sibecon.de

You can find further information about our company, details of authorised representatives and other contact details on our website’s legal notice: http://sibecon.de/impressumdatenschutz/

Which of your data will be processed by us? And for what purpose?
We process the data which you have provided in connection with your application in order to check your suitability for the position (or any other open positions in our company) and to complete the application process.

What is the legal basis for this?
The legal basis for processing your personal data as part of this application procedure is primarily s. 26 BDSG (German Federal Data Protection Act) as amended on 25 May 2018. Accordingly, the processing of the data relating to the decision of entering into an employment relationship is permitted.
If the data is required for legal prosecution following completion of the application procedure, it may be processed on the basis of Art. 6 GDPR, in particular for safeguarding legitimate interests pursuant to Art. 6 (1) lit. f GDPR. In such a case, it is our interest to assert or defend claims.
If you provide us with your data by submitting an unsolicited application, we will store it in our applicant database on the basis of Art. 6 (1) lit. a GDPR.

How long is the data stored?
The data will be stored as briefly as possible during the application process for a specific position.

In the event that you have agreed to a further storage of your personal data or have submitted an unsolicited application to us, your data will be saved in our applicant pool. Your data will be stored in the pool until you revoke the future processing.

If you have been selected for a position as part of the application process, the data will be stored in our database until further notice.

Which recipients will have access to the data?
For the application process we use a specialised software provider. This service provider acts on our behalf and may obtain knowledge of your personal data during the maintenance of the system. We have concluded a so-called order processing contract with this service provider, ensuring that the data processing is carried out in a permissible manner.

Your application data will be reviewed by our staff after receipt of your application. Suitable applications will be forwarded internally to the respective consultants for the vacant position or, in the case of unsolicited applications, to the applicant pool. Then the further procedure will be agreed. Within the company only those persons have access to your data, who require it for the proper processing of your application.

Where is the data processed?
The data will be processed exclusively in computer centres of the Federal Republic of Germany.

Your rights as an “affected party”
You are entitled to information about the person-related data processed by us.
In the event of an information request, which is not made in writing, we would ask you to understand that we may demand proof from you that you are the person claiming to be.
You also have the right to correction or deletion or to restriction of processing, if you are legally entitled to do so.
In addition, you have the right to objection to the processing in accordance with the statutory provisions, if we process data in accordance with Art. 6 (1) lit f GDPR. You have the right to data transfer.
If we process data with your consent in accordance with Art.6 (.1) lit. a GDPR, you can revoke this consent at any time with effect for the future.

Right of appeal
You have the right to complain to a data protection supervisory authority about the processing of personal data by us.

Data sources
We primarily use the data you have sent to us. In addition, we collect information from the data you publish, e.g. on XING, Linkedin, Facebook, Twitter, Instagram, etc.

Third-country transfer and profiling
Your data will not be transferred to countries outside the EU or to international organisations. A processing based on an automated decision does not occur. Profiling, i.e. automated processing with the objective of evaluating certain personal aspects, does not occur either.
